By participating in Offer, participant forever and irrevocably RELEASES, DISCHARGES, INDEMNIFIES AND HOLDS HARMLESS icebreaker®, Alterra Mountain Company, Ikon Pass, Inc., their respective parent companies, affiliates (including, with respect to Alterra Mountain Company, Dundee Resort Development LLC dba Arapahoe Basin Ski Area, Snow Summit, LLC, Crystal Mountain, Inc., Deer Valley Resort Company, LLC, Mammoth Mountain Ski Area, LLC, Mammoth Mountain Ski Area, Palisades Tahoe Resort, LLC, Palisades Tahoe Ski Holdings, LLC, Schweitzer Operations Inc., Solitude Mountain Ski Area LLC, Snowshoe Mountain, Inc., The Stratton Corporation, Steamboat Ski & Resort Corporation, and Intrawest/Winter Park Operations Corporation), subsidiaries, divisions, and advertising and promotion agencies as well as the officers, directors, employees, representatives and agents of each of the foregoing (collectively, the “Releasees”), from and against any claims, damages or liability due to any bodily injuries, death, damages or losses to any person or property of any kind resulting in whole or in part, directly or indirectly, from the Offer (including, without limitation, by participating in activities at the qualifying resorts) including but not limited to icebreaker®’s inability to provide a discounted lift ticket to you for any reason as well as the acceptance, possession, receipt, use/misuse of the discounted lift ticket (as applicable). Participant further COVENANTS NOT TO SUE any of the Releasees with respect to any matter addressed by the foregoing release, or encourage or assist any third party in doing so.
